2. PURPOSE OF THESE TERMS
These general terms expressly regulate the conditions applicable to the online purchase processes carried out by customers through the website madeinspaingourmet.com.
These terms remain in force while they are published on the website, without prejudice to the right of ADP Global Marketing Consulting SL to modify them, together with any legal texts published on the website, when necessary for legal, operational or commercial reasons.
The customer is subject to the terms in force at the time of placing the order. It is not possible to complete a purchase without prior acceptance of these Terms of Sale.
3. PARTIES INVOLVED
The electronic contracting process is carried out between ADP Global Marketing Consulting SL, as seller, and the user who purchases products through the website, as customer.
The customer declares that they are of legal age, have sufficient legal capacity to contract and provide truthful, complete and updated information during the purchase process.
4. RIGHT OF EXCLUSION
ADP Global Marketing Consulting SL reserves the right to deny or withdraw access to the website, cancel accounts, reject orders or suspend services without prior notice where users breach these terms, applicable law, good faith, public order or the rights of the company or third parties.
5. ELECTRONIC CONTRACTING PROCESS
5.1 Product information and availability
The website displays the products offered for sale, including commercial name, description, format, image, price, availability and any relevant information for the customer. Product information is prepared with care, but minor differences may exist between the image and the final product due to format, packaging, vintage, batch or manufacturer updates.
Product availability may vary depending on stock, supplier availability, seasonality, delivery area or logistics limitations. If a product purchased by the customer becomes unavailable, ADP Global Marketing Consulting SL will inform the customer and offer, where possible, a replacement, partial shipment, waiting period or refund of the affected amount.
5.2 Contracting phases
The purchase process generally includes the following phases:
- Selection of products and quantities.
- Review of the cart, prices, discounts, shipping costs and applicable taxes.
- Identification or registration of the customer, where applicable.
- Entry of billing and delivery details.
- Selection of the shipping method available for the destination.
- Selection of the payment method.
- Acceptance of the Terms of Sale and, where applicable, other legal conditions.
- Payment through the selected secure payment method.
- Order confirmation by email once the order has been correctly registered.
The customer must review the order before payment. Any errors in product selection, quantities, delivery details or billing data must be corrected before confirming the purchase.
5.3 Prices
Prices are displayed in euros. Unless otherwise indicated, prices include VAT or applicable indirect taxes. Shipping costs, discounts, promotions and any additional charges are displayed before the order is confirmed.
ADP Global Marketing Consulting SL may modify prices at any time. Such changes will not affect orders already confirmed, except in the event of obvious typographical or system errors that are recognizable as such by an average consumer.
5.4 Shipping method
Orders are shipped through the logistics providers enabled by the store for each destination. Delivery times are estimated and may vary depending on the destination, product availability, payment confirmation, customs procedures, incidents with the carrier, holidays, force majeure or circumstances outside the control of ADP Global Marketing Consulting SL.
5.4.1 Delivery area
The delivery area is the one enabled on the website at the time of purchase. If the destination entered by the customer is not available, the website may prevent checkout or ADP Global Marketing Consulting SL may contact the customer to evaluate possible alternatives.
5.4.2 Shipping costs
Shipping costs are calculated based on destination, order amount, weight, volume, product type, delivery method and any active promotions. The customer can review them before confirming the order.
6. ECONOMIC CONDITIONS AND PAYMENT METHOD
6.1 Payment methods
Payment may be made through the payment methods displayed at checkout, including, where available, credit or debit card, PayPal, bank transfer or other enabled methods.
Card and PayPal payments are processed through secure external gateways. ADP Global Marketing Consulting SL does not store complete card numbers. The customer must follow the instructions of the selected gateway and provide any authentication required by the bank or payment provider.
If payment is not authorized, is rejected, is cancelled, is returned or cannot be verified, the order may remain pending, be cancelled or not be processed until the situation is resolved.
7. AFFILIATE PROGRAM
The website may have an affiliate, collaborator, recommendation or commercial prescriber program. Participation in such program requires acceptance of the specific conditions communicated by ADP Global Marketing Consulting SL.
7.2 How affiliate status is obtained
Affiliate status may be granted after the corresponding request, validation of the applicant, acceptance of the program conditions and activation by ADP Global Marketing Consulting SL. 7.3 Affiliate commissions and payments

Orders cancelled, returned, fraudulent, unpaid or subject to chargeback may be excluded from commission calculation. Payment periods, minimum amounts, tax obligations and supporting documents shall be those established in the program conditions.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY
All content, trademarks, images, texts, designs, product sheets, logos, source code and other elements of the website are owned by ADP Global Marketing Consulting SL or by third parties who have authorized their use.
The customer may not reproduce, distribute, transform, publicly communicate, extract or commercially exploit any website content without prior written authorization, except as permitted by law.
9. RIGHT OF WITHDRAWAL
Where the customer is a consumer, they may exercise the right of withdrawal within the legally established period, except in cases where the law excludes or limits such right.
Because the store sells food, gourmet, perishable, sealed, personalized or hygiene-sensitive products, the right of withdrawal may not apply to products that may deteriorate or expire quickly, sealed products that are not suitable for return for health protection or hygiene reasons once unsealed, personalized products, products inseparably mixed with others after delivery, or any other case excluded by applicable consumer regulations.
To exercise the right of withdrawal where legally applicable, the customer must notify ADP Global Marketing Consulting SL unequivocally by email at info@madeinspain.store, indicating the order number, customer identification and products affected.
MECHANISM FOR EXERCISING THE RIGHT OF WITHDRAWAL
The customer must send the withdrawal request within the legal period and return the product in perfect condition, unused, complete, with original packaging and with all accessories, documents and labels, unless the nature of the product legally prevents return.
The return shipping costs may be borne by the customer unless otherwise required by law or unless the return is due to an error attributable to ADP Global Marketing Consulting SL.
Once the returned goods have been received and checked, the refund will be processed using the same payment method used by the customer, unless another method has been expressly agreed and does not generate additional costs for the customer.
If the product arrives damaged, incomplete or incorrect, the customer must contact ADP Global Marketing Consulting SL as soon as possible, providing order details and photographs that allow the incident to be assessed.
10. DISCLAIMER OF LIABILITY
ADP Global Marketing Consulting SL shall not be liable for delays, failures or non-performance caused by force majeure, carrier incidents, strikes, customs delays, incorrect data supplied by the customer, payment gateway failures, supplier stock shortages or any circumstance beyond its reasonable control.
The company shall not be liable for damage arising from misuse of the products, incorrect storage after delivery, failure to follow manufacturer instructions, allergies or intolerances not previously checked by the customer, or use of the website contrary to these terms.
11. GROUNDS FOR TERMINATION OF THE CONTRACT
The contract may be terminated when there is serious breach of these terms, non-payment, fraudulent use of payment methods, false information supplied by the customer, abusive conduct, impossibility of delivery, unavailability of the purchased product without accepted alternative, or any cause recognized by applicable law.
Where an order cannot be completed, ADP Global Marketing Consulting SL will inform the customer and refund the amounts that legally correspond.
12. LANGUAGE
The website may be available in several languages. In case of discrepancy between versions, and unless mandatory consumer law provides otherwise, the Spanish version shall prevail because it is the original legal version prepared for the owner of the website.
13. APPLICABLE LAW AND JURISDICTION
These Terms of Sale are governed by Spanish law. Any dispute shall be submitted to the competent courts in accordance with applicable consumer and procedural regulations.
If the customer acts as a consumer, the legally established jurisdiction rules shall apply. If the customer does not act as a consumer and no mandatory rule provides otherwise, the parties submit to the courts and tribunals of Barcelona, Spain.
